2.Registration
To order Jewellery from Shree Ganesh Jewellers, you must make an account, be 18 years old or over and be a resident of the United Kingdom.
You must ensure that the details provided during registration or at any time after registration about yourself is factual, correct, and up to date. If there are any changes then you must inform us.
You are entirely responsible for maintaining the confidentiality of any password and account information. If you know or suspect that someone else knows your password, you should contact us immediately.
Also, you are entirely responsible for all activities that occur under your account. You must notify Shree Ganesh Jewellers immediately of any unauthorised use of your account or any other breach of security. Shree Ganesh Jewellers will not be liable for any loss that may incur as a result of someone else using your password or account, either with or without your knowledge. However, you could be held liable for losses incurred by Shree Ganesh Jewellers or another party due to someone else using your account or password.
We reserve the right to refuse membership or withdraw membership of the Website and Service to any User, at any time, and for any reason.
3. Our Products
We offer products for sale that are in stock and available for dispatch. Sometimes, high demand causes us to run out of certain products. If we don’t have a product that you have ordered in stock, we’ll notify you by email immediatelyand refund any payment made by you within thirty days of being advised that products become unavailable.Our store does not stock all of the products on our website. If you wish to view an item in store before placing an order, please contact the store in advance to ensure that the item you want is available.
Whilst we have made every effort to display products as accurately as possible, Images of products on this website should be for illustrative purposes only. We cannot guarantee that your monitor’s display of any colour will accurately reflect the colour of the actual goods. Therefore, your goods may vary slightly from the image shown on the website. We cannot be held responsible for any inaccuracies or errors beyond our control.
Products will also not include any of the pictured accessories, unless stated in the specification of the goods.
Whilst we try to be as accurate as possible with measurements, dimensions, sizes and weights, all such descriptions are approximate onlyand is provided in good faith.
4. Placing Orders
You can use our website to place an order by selecting the product you wish to buy and adding it to your basket. Items you do not require can be removed from your basket at any time. Products are subject to availability and Products that are in your basket are not reserved and can be purchased by other Users. We will do our best to remove any Products which have sold out at the earliest opportunity.
When you place an order with us online, you are making an offer to buy goods. Once you have submitted your order or offer you cannot change or withdraw the order or offer.We will send you an e-mail to confirm that we have received your order. However, this does not mean we will be able to accept your order.We will be under no obligation to supply the products ordered.
We do not have to accept your order, and for example, acceptance of orders will depend on factors such as, but not limited to:
- Whether the goods are available
- There is an error on the website regarding the price or description of a product.
- Fraud and identity checks being passed
- The Company does not receive your payment within 1 working day
- A period of extreme price volatility in the metal trading market.
- We do not deliver to your area
- We have tried contacting you about your order and have not heard back within a reasonable period of time.
We reserve the right to cancel your Order even after we have accepted it, for any of the reasons.
We may obtain various details from you so that we can accept and process your Order.This may involve us asking for Government Official ID and official letters from yourself. You must ensure that the details which you provide each time you place an Order are correct and complete.
By placing an order with us, you agree to and accept these terms, as well as our privacy policy and the terms of website use. However, if the order is not accepted then there will be no contract between us. We will contact you and try to find a resolution.
Once the order is accepted and have been paid for in full,we will despatch your order and send an email confirmation to let you know it’s on its way. It is at this point that a contract will exist under these terms and conditions.
In the event that we are able to supply some but not all of the goods on the Order Form, the whole amount for all the goods on the order form will be taken from your credit or debit card but a full refund will then be made, on dispatch, for the unavailable goods.
5. Pricing and Payments
Prices throughout the website are quoted in GBP (British Pound Sterling), and payment can only be accepted in the same (GBP). Payment can be made by any method specified in ‘payment section’ and prices include packing and delivery costs.
The price you pay is the price of the products shown at the time you place your order, even if the price of the product has since changed.Furthermore, we take reasonable care, in so far as it is in our power to do so, to keep the details of your order and payment secure, but in the absence of negligence on our part we cannot be held liable for any loss you may suffer if a third party procures unauthorized access to any data you provide us when accessing or ordering from the Website.
If you make an unjustified credit card, debit card or other charge-back (including if you fail to recognise or remember the transaction on your card statement or other financial statemen)then Shree Ganesh Jewellers has the right to recover its direct and indirect costs plus an administration fee of GBP 30.00 including VAT, within 8 days following the date of our written request.
We endeavour to ensure that all Products on the Platforms are available at the same price in our store. However, from time to time we may offer additional discounts for purchases made via the Platforms that do not apply in store, or vice versa. Additionally, Products offered as sets on the Platforms may not be offered as part of a set-in store and individual prices may apply.
If we discover an error in the price of goods you have ordered we will inform you of this fact as soon as possible. You will be given the option of reconfirming your order at the correct price or cancelling it. If we are unable to contact you, we will treat the order as cancelled. If you cancel and you have already paid for the goods, you will receive a full refund.
If purchasing a quote, the buyer accepts full responsibility for checking the accuracy of that quote.
6. Delivery & Carriage Charges
We post to the UK only. If you are outside of the UK please contact us first before attempting to order an item, and we may be able to accommodate you on a one-off basis.If, however, we accept an Order for delivery outside that area, you may need to pay import duties or other taxes, as we will not pay them.
We use the services of the Royal Mail for our deliveries. For items over £100 we use Royal Mail Special Delivery tracked, signed and fully insured for postage. Items which are £100 or under will be sent via Royal Mail 48 hours tracked and signed postage which is also fully insured.
The delivery address you give must match the credit or debit card used to pay for a product. For fraud prevention purposes we may on rare occasions ask you to provide identification documents.
We aim to deliver any Good(s) in stock within 2-4 working days after the day on which we accept Your order. Once the order has been placed the delivery address cannot be changed under any circumstances.Delivery charges and estimated timescales are specified when you place an order. We make every effort to deliver goods within the estimated timescales, however delays are occasionally inevitable due to unforeseen factors. We shall be under no liability for any delay or failure to deliver the products within estimated timescales. These might include things such as accidents, breakdowns, fire, flood, storm, severe weather, acts of god, war, riot, civil commotion, malicious damage or the default of our suppliers. Any dates quoted for delivery are approximate only and the time of delivery will not be of the essence of the contract.
We will deliver the goods to the premises you specify on your order. You must be at delivery address to accept delivery of your order.Your signature will be required on receipt of the goods. If there is no one to accept the order on the scheduled delivery date the goods may be returned to Shree Ganesh Jewellers and we reserve the right to charge you an additional cost of storing and redelivering them.The liability for any loss is yours wheredelivery is subject to a postal redirection or to a PO Box or mail box address, ora house of multiple occupation. All orders will be deemed delivered when signed for by anyperson at the delivery address or confirmed as delivered by couriers. Youmust satisfy yourself before requesting any delivery that this will be secure asany loss incurred after the delivery is signed for at the address or confirmed asdelivered bycouriers will be your liability.
You should not accept or sign for any delivery where the package has been
damaged, resealed or tampered with and instruct the courier to return the item to
us. If you sign for and accept delivery of a damaged or tampered with parcel the insurance cover of the contents will be void and any loss discovered when the parcel is fully opened will not be covered. You must also inform us of a rejected delivery without any delay.We cannot accept any liability for loss once a package has been accepted by
any person at the delivery address.Risk of loss and damage of products passes to you on the date when the products are delivered.
Goods from same order may be split into multiple deliveries as per our discretion in order to have suitable insurance cover.
7.Collection Service
Our collection service is subject to conditions. On collection you must present to us the originals of the ID, copy of invoice, original payment card if requested, including any additional ID information we have requested from you, and it must match any ID previously provided to us, and we must still be able to verify the ID. If any of the conditions is not met, we will not provide your goods for you to collect.
If you fail to collect on time If you fail to collect the item(s) within 10 working days of us telling you they are available, normally we will try to contact you and attempt to arrange collection again.
Ultimately, if we are unable to arrange collection again, or if you do not collect within 10 working days of us telling you the item(s) are ready, at our discretion we may either sell the item(s) and reimburse you for the sale price of the item(s) after deducting our fees, charges and costs, or store the items.
Our collection service is complete when you have collected the item(s) from us, or when we have completed or been released from our obligations in accordance with these terms and conditions.
8. Cancellation and returns
As we supply goods which are priced according to fluctuations in the financial market and such fluctuations cannot be controlled by us, the supplier, there is no option to cancel your order to us under the provisions of the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013.However, if you are not happy with your purchase, we will try to resolve any issues or issue a refund subject to conditions.All requests for order cancellation will be considered on an individual basis and the Company’s decision as to whether or not to allow a requested cancellation will be final and binding.All purchases are non-refundable, non-exchangeable unless otherwise agreed by us in writing and are subject to our discretion.
Due to nature of items we sell and fluctuations in the financial market, all such cancellation requests will be subject to our Loss policy.
- A cancellation/restocking fee of up to 30% and a fee based on any adverse movement of the spot price value of the order between the submission of the order and the cancellation of the order.
- Any market gain on cancellations shall remain the property of Shree Ganesh Jewellers.
- An administration fee will also be incurredof GBP 30.00 including VAT.
- We will deduct the total sum payable to Us from payments that you have made to us in respect of subsequently cancelled orders. Any refunds of payments, following the deduction of payments due to Us, will be made to the source of the original payment.Please allow up to 7 working days for this process to complete.
You can apply to cancel your contract at any time up to 14 days after the day of delivery. To do this, please e-mail us. Any cancellation request e-mails must be successfully received by the Company.We are unable to accept cancellations by phone. You do not have to give any reason for cancellation. However, a brief explanation will help us to improve the service we offer to customers in the future.
You must return the goods within 14 days of cancellationat your own expense, complete with the original packaging,presentation boxes, certificates and all other documentation.You can use Royal mail Special Delivery or any other courier of your choiceand make sure you insure for the correct amount. You must ensure that the goods are packaged adequately to protect against damage.We do not refund on items lost in transit. We are not liable for goods until they are in our possession.Orders areonly refunded once they have been returned and inspected to ensure they are in the same condition as when they left the ownership of Shree Ganesh Jewellers. You must not have worn or damaged the goods. You must not have removed any tags from the item. If an item is returned in a condition other than stated above, the refund may be cancelled or only a partial refund offered. Our promise to refund your money does not apply to faults or damages caused by accident, neglect or misuse under any circumstances.
Please note that we cannot exchange or refund items engraved or in any way personalised or custom ordered unless they are defective or faulty. Ear and nose jewellery (Earrings, Nose Pins and nose rings etc..) are strictly non-refundable and non-exchangeable due to hygiene reasons. Bullion bars, Coins, Solid gold jewellery are also strictly non-refundable.
Any returns without prior communication in writing will be refused and will go back to sender. You will have to pay the delivery fee.
9. Faulty Goods
If you are returning the product because of an error on our part or manufacturing fault, Shree Ganesh Jewellers will be happy to refund all costs associated in returning the item back to us, as well as your original postage costs.
If there is a problem with the goods, please notify us by email providing details of the problem.We reserve the right to refuse replacements or refunds on any damaged items reported to us outside 24hrs from delivery. In addition, you must provide us with a digital photograph of the problem as this saves you having to return the goods for inspection. We will deal with the matter in accordance with your legal rights.
If the digital photograph indicates that the goods are faulty, we will send you a confirmation email to return the goods. The cost of returning goods to us is your responsibility, however on inspection we will refund your reasonable postage costs, providing that the goods are found to be faulty.Replacement goods will then be despatched or we will issue a refund. If the goods are not faulty, we will return them to you, however you will be required to cover our reasonable costs.
Please note gold jewellery can sometimes be very delicate, you should always take care when handling, storing or wearing it, we will always inspect the item and photograph it before dispatching.
10. Liability
Nothing in these Terms excludes or limits liability for death or personal injury caused by our negligence or fraudulent misrepresentation.
In the absence of any negligence or breach of duty by us, your use of any of the Products other than in accordance with their instructions is entirely at your own risk.
You will be responsible for all liabilities, claims and expenses that arise out of the content you submit post or transmit via the Website, or from your use/misuse of the Website or the use/misuse by any person for whom you are responsible or from your violation of the Terms.
Shree Ganesh Jewellers warrants that it will provide the Products with reasonable skill and care, within a reasonable time, and substantially as described in these Terms. Shree Ganesh Jewellers does not make any other promises or warranties about the provision of the Products.
Shree Ganesh Jewellers cannot assume any liability for:
- Any viruses or any other disabling features that affect your access to or use of the website
- Any incompatibility between the Website and other websites, services, software and hardware;
- Any delays or failures you may experience in initiating, conducting or completing any transmissions or transactions in connection with the Website;
- Any modification, suspension or discontinuance of the Website.
If either you or we are in breach of the arrangements under these Terms, neither of us will be responsible for any losses that the other suffers as a result, except those which are a foreseeable consequence of the breach. Losses are foreseeable where they could be contemplated by both you and us at the time you place an Order.
11.Intellectual property rights
The content of the Website is protected by intellectual property law. You may retrieve and display the content of the Website on a computer screen, store it in an electronic form on a hard drive or print a copy of the content for Your own private and non-commercial use under the condition that all and any copyright and proprietary notices are clearly visible.
No licence is granted to you in these Terms to use any trade mark of Shree Ganesh Jewellers or its affiliated companies.
12.General
Shree Ganesh Jewellers shall be under no liability for any delay or failure to deliver Products or otherwise perform any obligation as specified in these Terms if the same is wholly or partly caused whether directly or indirectly by circumstances beyond its reasonable control.
These Terms and Conditions, the Contract and the relationship between you and Us (whether contractual or otherwise) shall be governed by, and construed in accordance with, the law of England & Wales
